Planning Enforcement Action at Upton Brooks

Dear Cllr Ballard,
 
I write with reference to the above to update you in particular with reference to Conditions 15, 16 and 18 of the above permission.
 
The details of the Conditions imposed is set out below:
 
Condition 15
 
The development shall not commence until full details of the proposed foul water drainage scheme have been submitted to and approved in writing by the Local Planning Authority. (Including details of its routing, design, and subsequent management/maintenance).
No building shall be occupied until the foul water drainage scheme has been implemented in accordance with the approved details.
Reason: To ensure that the proposed development is satisfactorily drained in accordance with policies GEN7 and GEN9 of the Arun District Council Local Plan.
 
Condition 16
 
Development shall not commence until full details of the proposed surface water drainage scheme have been submitted to and approved in writing by the Local Planning Authority.
The design should follow the hierarchy of preference for different types of surface water drainage disposal systems as set out in Approved Document H of the Building Regulations, the recommendations of the SUDS Manual produced by CIRIA. Winter groundwater monitoring to establish highest annual ground water levels and Percolation testing to BRE 365, or similar approved, will be required to support the design of any Infiltration drainage. No building shall be occupied until the complete surface water drainage system serving the property has been implemented in accordance with the agreed details.
Reason: To ensure that the proposed development is satisfactorily drained in accordance with policies GEN7 and GEN9 of the Arun District Council Local Plan.
 
Condition 18
 
Development shall not commence until full details of the maintenance and management of the SUDs system is set out in a site-specific maintenance manual and submitted to, and approved in writing, by the Local Planning Authority. The manual is to include details of financial management and arrangements for the replacement of major components at the end of the manufacturers recommended design life. Upon completed construction of the SuDs System, the owner or management company shall strictly adhere to and implement the recommendations contained within the manual.
Reason: To ensure the efficient maintenance and ongoing operation of the SuDs system and to ensure the best practice in line with guidance set out in 'The SuDs Manual' CIRIA publication ref: C697 Chapter 22.
 
The details reserved by the above conditions was submitted under cover of application ref. EG/53/13/DOC.
 
The requirements of Conditions 15 and 16 have not been complied with – the dwellings were occupied without compliance with the Conditions. Condition 18 was found not to have been complied with and remains under review and do Conditions 15 and 16.
 
In brief, the foul drainage, that is the sewerage treatment plant is currently the responsibility of Gateway Property Management, it being the subject of transfer from the developer I understand back in May ’17. Fay O’Connell, Environment Agency reported in May that this plant was to be taken over by Southern Water Authority after a period of maintenance. I understand from the developer that we are still within the maintenance period. Handover is expected  sometime next year as and when the water authority are satisfied with its satisfactory operation.
 
Barratts and the Council’s engineers have been corresponding to establish all the detail required to demonstrate that the surface water drainage is operating as required. Various CCTV surveys have been submitted to the Council and inspections made. At this time, further CCTV data has been requested and is awaited. I am meeting with the developer in early January on site in the company of the engineer to inspect again various aspects of the drainage system before the Council can be clear that Condition 16 and 18 is being complied with.
 
Gateway Property Management are responsible for the maintenance of the SUDS. Following a number of requests from the Council, maintenance of this area has occurred to improve its condition. When we meet in January, its operation and maintenance will be reviewed with reference to the manual approved.
 
In line with the requirements of the landscaping condition approved, certain dead trees have been replaced which were brought to the attention of the maintenance company. Other trees damaged and dead have been further reported and this aspect again will be addressed in January. You will be aware of application ref. EG/60/17/PL which was received on 19 July for variation of Condition 2 (plans) and 6 for landscaping details imposed under planning permission EG/29/13. This application relates to changes as built to the site access. (At this time, Condition 6 and 2 have been breached.)
 
The electricity substation which was in a poor state of repair due to vandalism has been smartened up following complaints received. I passed on complaints earlier in the year.
